1. Acceptance of Terms
By accessing or using Maglux POS ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.
2. Description of Service
Maglux POS is a cloud-based point-of-sale and restaurant management platform designed for cafés, restaurants, and food service businesses. The Service includes order management, billing, table management, menu management, KOT printing, customer management, and reporting features.
3. Account Registration
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
4. Subscription and Payment
Maglux POS offers a free trial period followed by paid subscription plans. Subscription fees are billed in advance on a recurring basis. Payments are processed securely through Razorpay. All fees are quoted in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
5. Acceptable Use
You agree not to misuse the Service, including (but not limited to) attempting to gain unauthorized access, interfering with the Service, transmitting malicious code, or using the Service for any unlawful purpose.
6. Data Ownership
You retain ownership of all data you input into the Service (menu items, orders, customer records, etc.). We act as a data processor on your behalf and will not share your business data with third parties except as required to operate the Service or as required by law.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We are not liable for any downtime, data loss, or business interruption.
8. Limitation of Liability
To the maximum extent permitted by law, Maglux POS and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the preceding three months.
9. Termination
We may suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time from your billing dashboard. Refer to our Refund and Cancellation policies for details on cancellation effects.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
